Smoking in cars: laws, rules and safety tips explained

Smoking while driving is generally legal in the UK, but there are exceptions. Since 2015, it’s illegal to smoke in a car carrying someone under 18, or to allow smoking in such circumstances. Violations can result in a £50 fine for both the smoker and the driver. This law does not apply to convertibles with fully open roofs or to e-cigarettes and vapes. Seventeen-year-olds can smoke in their cars if alone.

For work vehicles, the laws vary across the UK. In Scotland, Northern Ireland, and Wales, it’s illegal to smoke in work vehicles unless it’s a private car. In England, work vehicles must be smoke-free if they transport the public or are shared by multiple people for work purposes. Such vehicles must also display a no-smoking sign unless they are fully open-top.

While smoking in private vehicles is not illegal, it’s considered a potential distraction under Rule 148 of The Highway Code, similar to loud music or eating. Drivers must ensure their attention remains fully on driving to avoid accidents.
